1. Purpose and acceptance

These Terms of Service (the "Terms") govern access to and use of the saintsoft.us website and its associated contact channels, owned by SaintSoft S.A.S., domiciled at Carrera 63 #174B-11, Bogotá D.C., Colombia.

By browsing the site, submitting the contact form or contacting us through the channels published here, you confirm that you have read, understood and accepted these Terms and the Privacy Policy. If you do not agree with them, please do not use the site.

Under Ley 527 de 1999, declarations of intent expressed through this site and through data messages are fully valid and admissible as evidence.

2. Capacity and permitted use

The site is aimed at adults with the legal capacity to contract and at legal entities acting through a duly authorized representative. If you use the site on behalf of a company, you confirm that you have sufficient authority to do so.

You agree to use the site in accordance with the law, good faith and these Terms. In particular, the following is not permitted:

• Submitting, through the form or any other channel, content that is unlawful, defamatory, discriminatory, misleading or that infringes third-party rights.
• Impersonating another person or entity, or providing false contact details.
• Introducing malicious code, performing injections, intrusive scans, unauthorized penetration testing or any action that compromises the availability or integrity of the site.
• Extracting content in bulk by automated means (scraping) without our prior written authorization.
• Using the contact form to send unsolicited commercial communications.
• Circumventing or attempting to circumvent the site's technical security measures.

Breaching these rules may result in access being blocked, without prejudice to any legal action available, including that provided for in Ley 1273 de 2009 on computer crime.

3. Intellectual property

All content on the site — text, structure, design, interfaces, graphics, source code, the SaintSoft trademark, its logos and distinctive signs — belongs to SaintSoft S.A.S. or its licensors, and is protected by Ley 23 de 1982, Andean Decision 351 of 1993 and Andean Decision 486 of 2000.

Accessing the site grants no licence or assignment over those rights. You may view, print and download content for personal use or for your organization's internal use, provided it is not altered and the source is credited. Any reproduction, distribution, public communication or transformation for commercial purposes requires prior written authorization.

Third-party trademarks and trade names appearing on the site, including those of clients and technologies mentioned, belong to their respective owners and are used for information purposes or with their authorization, without implying sponsorship or affiliation unless expressly stated.

4. Nature of the published information

Descriptions of products, capabilities, timescales, scope and results published on the site are illustrative. The specific scope, price, timescales, service levels and warranties for any project are defined exclusively in the commercial proposal and the contract the parties sign, and those documents prevail over any site content in the event of a discrepancy.

The case studies and figures mentioned correspond to specific implementations in specific operational contexts. They are neither a promise nor a projection of the results another organization might obtain.

5. Contact form and communications

Submitting the contact form creates no obligation to contract for either party. We undertake to respond to requests received within a reasonable time, without this amounting to an enforceable service level.

By submitting it, you confirm that the data provided is true and current, and that you are authorized to provide any contact details you include. The processing of that data is governed by the Privacy Policy.

WhatsApp communications take place on a third-party platform and are additionally subject to its own terms of use and privacy policy.

6. Site availability

We aim to keep the site continuously available, but we do not guarantee uninterrupted availability or freedom from errors. We may suspend, limit or interrupt access, wholly or partly, for reasons of maintenance, security, updates or force majeure, without prior notice and without this giving rise to any right to compensation.

We reserve the right to modify, update or remove the site's content and structure at any time.

7. Links to third-party sites

The site may include links to third-party pages and services. Those links are offered solely to make it easier to reach information you may find useful. We neither control nor are responsible for their content, their privacy practices or their availability. By following an external link you leave our site and become subject to the destination's terms.

8. Limitation of liability

To the fullest extent permitted by applicable law, SaintSoft shall not be liable for indirect damages, loss of profits, loss of data or loss of business opportunities arising from the use of, or inability to use, the site, nor for decisions you take relying solely on the information published on it.

This limitation neither excludes nor restricts liability that under Colombian law cannot be excluded: in particular liability arising from wilful misconduct or gross negligence, liability relating to personal data protection, and liability owed to consumers under Ley 1480 de 2011.

9. Consumers

Where the recipient of our services qualifies as a consumer under Ley 1480 de 2011, they enjoy the rights recognised there, including those concerning information, the statutory warranty and, for distance electronic commerce transactions, the right of withdrawal under article 47 of that law.

10. Amendments to the Terms

We may amend these Terms at any time. The version in force is the one published on this page, with its version number and effective date shown at the top of the document. Using the site after a new version is published constitutes acceptance of it.

11. Severability

If any clause of these Terms is declared void, ineffective or unenforceable by a competent authority, it shall be deemed not written and the remainder shall retain full validity, the whole being interpreted in the way that comes closest to the parties' original intent.

12. Language

These Terms are published in Spanish and in English. The Spanish version is the only authentic one and prevails in the event of any discrepancy, contradiction or doubt as to interpretation between the two. The English translation is provided for information purposes.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute relating to their interpretation, validity, performance or termination shall be submitted to the competent courts of Bogotá D.C., Colombia, unless a mandatory consumer protection rule assigns jurisdiction elsewhere.
